Information for residential property sellers and buyers

Curtis & Co and all our agents and salespeople are licensed under the Real Estate Agents Act 2008 - you can check this on the REAA website or call them on 0800 3677322. We are also bound by the Real Estate Agents Act (Professional Conduct and Client Care) Rules 2012 required by section 14 of the Real Estate Agents Act. The rules should be read in conjunction with the Act and Regulations. We are also members of the MREINZ.

As either a purchaser or seller of residential property there are specific documents that Curtis & Co must legally provide you with before signing any agreements with you. If you are considering listing a property you will be given a copy of the New Zealand Residential Property Agency Agreement Approved Guide. Buyers and sellers will be given a copy of the New Zealand Residential Property Sale and Purchase Agreement Guide. These have been prepared by the Real Estate Agents Authority and can also be viewed on their website www.reaa.govt.nz. As either a purchaser or seller, you will be asked to sign a form with Curtis & Co acknowledging receipt of these Guides before you sign any agreements with Curtis & Co.

Curtis & Co also has to provide sellers with a written appraisal of their property and a clear written estimate of our commission. We must also discuss the different options with you for selling your property. We must explain marketing and advertising costs and disclose rebates, discounts and commissions.

We must also inform you if there is a conflict of interest and we will recommend that you seek legal advice before signing any documents or agreement with us.

We will also explain to you when the agency agreement ends.

Curtis & Co must have a signed Agency Agreement with all sellers before marketing the property.

Curtis & Co is required by law to have a Complaints and Disputes Resolution Procedure. The details of this process are outlined below. Customers or clients may access the Real Estate Agents Authority's (REAA) complaints process without first using the Curtis & Co in-house procedure.

GST
Most residential property transactions are GST exclusive. GST is charged on real estate agent fees and other charges made by agents.

Code of Conduct
The Real Estate Agents Authority has a code of conduct (The Professional Conduct and Client Care Rules 2012) Real Estate Agents Act (Professional Conduct and Client Care) Rules 2012 that all agents must abide by. Members of the public can access a copy of the code on the REAA website www.reaa.govt.nz.

Complaints and Disputes Resolution Process
At Curtis & Co we take our professional role extremely seriously. We are committed to handling any complaints quickly and fairly for all concerned. Our procedure for dealing with complaints is:

  1. Any client or customer who wishes to make a complaint will be referred to the Agent and business owner David Curtis.
  2. Complainants will be asked to make the complaint in writing.
  3. Following receipt of the written complaint by the Agent a full review of the issue will be undertaken. This may include a meeting between the parties.
  4. Following that review a written response will be provided to the complainant.
  5. If the complainant is not satisfied with the response, a further meeting will be held with the Agent and the complainant to determine an alternative process/outcome.

Customers or clients may access the Real Estate Agents Authority's (REAA) complaints process without first using the Curtis & Co in-house procedure. If you choose to use the Curtis & Co in-house procedure this does not preclude a customer or client from making a complaint to the REAA.
